What Can You Commission from Me?
I WILL DRAW:
- People (any race, age, body type, nationality, or gender)
- Hair (any texture, colour, and style)
- Casual clothing (modern or traditional)
- Swimsuits, pyjamas, and underwear/lingerie*
- Formal clothing (modern or traditional)
- Cultural clothing (with sufficient references)
- Jewelry and accessories
- Facial expressions
- Small animals and children
- Original characters
- Personal and/or family portraits
- Blood and/or gore*
- Things that help foster unity, harmony, and cultural diversity (even if considered politically controversial)*
* Accepted at my own discretion.
I reserve the right to refuse any commission for any reason.
I WILL NOT DRAW:
- Hateful or inaccurate depictions of other people or characters
- Hateful outfits and/or symbols
- Overly sexual outfits (NSFW)
- Full or partial nudity (i.e. anything normally covered by underwear)
- Violent and/or sexual acts
- Fetishes
- Abuse of children, minors, elders, animals, etc.
- IRL Political figures (ex: US presidents, etc.)
- Mechas/robots
- Characters not in the vanilla Stardew Valley game or belonging to other creators (without express written permission).
- Things that divide, foster hatred, separate, or gate-keep other people based on race, religion, ethnicity, background, sexuality, language, national history, etc.
I reserve the right to refuse any commission for any reason.
Terms and Conditions
If there are any issues with the following terms, they may be changed ONLY if discussed with me prior to paying your deposit. Any changes will be reflected in the "Amendments" section of our contract and a digital copy with be sent and signed by each party before commission work begins.
1. GENERAL TERMS
All drawings may include a subtle signature that you may not remove.
I may record the drawing process and post it on my YouTube, Tumblr or portfolio site(s).
Prices are subject to change based on demand.
I reserve the right to refuse or cancel/refund any commission for any reason.
2. PAYMENT
The currency accepted is USD and can be paid through PayPal or bank transfer.
A 50% non-refundable, non-transferable* payment is required upfront (after commission approval). The remaining 50% is due before final approval and the completed image files are sent. (*Please see section 7 for more details on deposits and refunds.)
Do not send me any payment(s) before I have agreed to give you a commission slot and have requested the non-refundable payment deposit (50%).
Ownership of the commission will only pass from the Artist to the Client on receipt of payment in full.
The commission will not be sent to the Client/Buyer until the agreed payment amount, including any outstanding balances and/or fees, has been received in full.
3. PROCESS AND DELIVERY
I will notify you when I have started on your commission and you, therefore, lose the rights to your deposit (Please see section 6 for more details on deposits and refunds.)
While working on your commission, I will review each step of the process with you to be sure you are satisfied. Reviews will take place over email or Discord, whichever you are more comfortable with.
The amount of reviews depends on the complexity of the work.
During reviews, you will see works-in-progress, which may include images with a watermark and in a lower-quality resolution than the finished piece.
Commission completion can vary from 1 week - 3 months depending on factors such as health, the complexity of the commissioned piece, other work and projects, as well as Convention seasons. I am not obligated to explain the reasoning behind extensions or delays for the completion of a commission, but will often do so out of courtesy.
I will NOT take on commissions that have 1.) strict or short deadlines; and 2.) if the Client is not flexible on deadlines. This is due to the nature of the aforementioned circumstances and is non-negotiable. If the commission is time-sensitive, a rush fee may be applied and will be defined and agreed upon in the commission contract prior to the start of work.
If anything comes up that will slow the progress of the initially estimated delivery time, I will let you know ASAP.
Once the piece is finished you will receive the full-resolution .png image along with a web-friendly size and Stardew Valley mod-ready integration. Please note there is no physical product.
4. REVISIONS
You will have three (3) opportunities to make changes to the commissioned piece throughout the design process, which is included in the base price.
An additional fee will incur if major changes are made to the final drawing - unless a misunderstanding has occurred from my end.
You will have one (1) opportunity for a (light) portrait revision/touch-up after the final image has been approved (and final payment has been received). If any major or drastic changes are requested, this may incur an additional fee. Charges are based on an hourly rate.
If the references you provide are unclear or insufficient (or you haven't given me any references at all), an additional fee may incur for photo or information reference searches. Charges are based on an hourly rate.
5. COPYRIGHT / USAGE POLICY
I, Elaho (the Artist):
I reserve the right to cancel and refund the order at any time for any reason.
I retain all copyrights over the commissioned artwork.
I will NOT claim the intellectual property (IP) of the commissioned artwork (i.e. your character is still yours, etc.).
I will NOT profit further from the commission unless you (the Client) break any of the terms.
I reserve the right to post the commission online, in my portfolio, as well as in publications such as art books, etc.
You (the Client/Commissioner/Buyer):
You may upload the commissioned artwork on any website and social channels.
You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD services, making prints for selling, etc.).
You MAY use the artwork in your own [free to play] self-published mods (ex: Nexus, Mod Drop, etc.)
You retain the rights to the intellectual property (IP).
You may NOT use the commissioned artwork for commercial purposes [whether monetized or not].
You may NOT use or submit the commission to any kind of contest (online or offline).
Credit is not required when posting but is greatly appreciated.
The following is considered copyright infringement:
Reproducing/using the copyrighted artwork commercially - meaning, making money off it in any way (which may or may not be included in these terms).
Claiming the artwork as your own.
Altering the artwork without my consent.
*In some cases, the commercial rights to the image may be purchased.*
6. REFUND / CANCELLATION POLICY
The Buyer is not allowed a refund once work is started on the commission. Written notification will be provided to the Client as proof of work started, either through email or Discord.
If, for any reason, I am unable to start your commission, you will receive a full refund.
If you cancel your order before I have started it (and have NOT been sent notice that work has begun), you can receive a full refund.
The "kill fee" for cancelling the commission after work has begun is 50% of the commission's price [i.e. the non-refundable deposit]. The Client then receives the work as is.
If the Buyer has paid the commission amount in full upfront (100%) but wishes to cancel the commission after the work has started, the Buyer can be issued a refund but agrees to pay the kill fee [i.e. the non-refundable deposit].
Paypal Specific:
If you are getting a refund, do NOT request a Paypal chargeback. I will transfer the money back to you myself.
If you request a Paypal chargeback at any point after the refund window has closed, you will lose all the beforementioned rights to the commissioned piece, and I will retain the right to profit from it further in any way I see fit. The chargeback request will be declined and I will provide Paypal with our contract and conversations (in which we discuss the commission) as evidence of completed work. Furthermore, you will be blacklisted from commissioning me again.
If the Buyer breaks any of the points stated above, they will lose all the beforementioned rights to the artwork commissioned by me, Elaho (the Artist), and I will have the right to profit further from the commissioned artwork in any way I see fit. If there are any issues with the aforementioned statements, they may be altered if discussed with me prior to paying your non-refundable deposit. Any alterations will be added in an amendments statement to our current contract and signed by both parties before work on the commission begins.
7. MORAL RIGHT
The Client is not permitted any use of the Artist's name or misuse of the commission which would reflect discredit on her reputation as an artist, or which would violate the spirit of the commission.
What Is Your Involvement in this Process?
Throughout the design process, there will be a variety of sketches and drafts for you to choose from. Depending on the complexity of the commission, there may be more or fewer drafts.
You will select which draft /sketch you like best in each major design stage. Your approval is needed before I continue to the next step.
You will provide insight and feedback on each stage of the design, including colour, style, and detailing. (Depending on the complexity of the commissioned piece.)
Full-resolution file (approx. 64 x 64 px at 72 PPI) of the final drawing and a larger version (with basic background) for internet upload. The final file format will be in PNG.
